Terms & Conditions

A legal disclaimer

1. Scope of Work: we at JayBud Contracting agree to perform all services as detailed in the signed project proposal or estimate. Any changes to the scope of work must be agreed upon in writing by both parties.

 

2. Pricing and Payment: The client agrees to pay the total amount specified in the project proposal. A down deposit is due upon signing the contract. The down deposit includes cost of material and 15% of the labor estimate. The labor estimate and material cost will vary depending on the project. Progress payments may be required at key project milestones. The final balance is due upon completion and client inspection. A failure to complete payment will result in legal action being taken.

 

3. Project Schedule: We at JayBud Contracting will provide an estimated timeline for the project. While every effort will be made to adhere to this schedule, delays may occur due to unforeseen circumstances, such as material shortages or adverse weather. We are not liable for delays outside of our control.

 

4. Client Responsibilities: The client agrees to provide clear access to the work area, ensure the site is free of obstructions, and make decisions on colours, textures, or other specifications in a timely manner. The client is responsible for moving and protecting their personal belongings from the work area.

5. Warranties and Guarantees: The contractor warrants that all work will be performed in a professional and workmanlike manner. A one year warranty is provided on labor and installation. This warranty does not cover damage caused by misuse, neglect, or issues with the underlying structure (e.g., water damage, shifting foundations). No Refunds.

 

6. Limitation of Liability: In no event shall the contractor be liable for any indirect, incidental, or consequential damages arising out of the project. The contractor's liability is limited to the total amount paid by the client for the services rendered.

 

7. Dispute Resolution: Any disputes arising from this agreement will first be attempted to be resolved through good-faith negotiation. If an amicable solution cannot be reached, the parties agree to Arbitration, negotiation, and mediation.

 

8. Governing Law: This agreement shall be governed by the laws of the province of Ontario.

 

9. Entire Agreement: This document, along with the project proposal, constitutes the entire agreement between the parties and supersedes all prior agreements or understandings.
